These Terms of Use (“Terms”) are a binding agreement between you and the developer of Amari (“we,” “us,” “our”), an independent developer based in Australia. They govern your use of the Amari mobile application, the website at amariapp.com, and related services (together, the “Services”).

By downloading, accessing or using Amari, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least eighteen (18) years old, or the age of legal majority where you live if that is higher, to create an account and use the Services. By using Amari you represent that you meet this requirement and have the legal capacity to enter into this agreement.

2. What Amari is

Amari is an app for couples. It helps you keep track of the dates that matter, save shared memories, answer questions together, check in with each other, and receive AI-generated suggestions for gestures, dates and gifts based on the profile information you provide.

3. Your account

You sign in with Sign in with Apple. You are responsible for keeping access to your Apple ID and device secure, and for activity that occurs under your account. Tell us at amariaiapp@gmail.com if you believe your account has been accessed without your permission.

4. Linking with a partner

a. Invite codes. You can link your account with one partner using an invite code. Once linked, each of you can see the other’s profile details and the content in your shared space, as described in section 6 of the Privacy Policy.

b. Share codes carefully. Only send an invite code to the person you intend to link with. Anyone who has a valid code can join your couple.

c. Information about your partner. When you enter information about another person, you represent that they know about it and have agreed to it. Do not enter information about a person who has not agreed, and do not use Amari to record information about someone covertly.

d. Unlinking. You can leave a couple at any time (More → Leave & start over). Leaving removes your data from the shared space, but content that has already synced to your partner’s device stays on their device. Plan accordingly before you share something you may later want back.

5. Amari Pro subscriptions

a. What Pro unlocks. Amari Pro is an optional auto-renewing subscription. It unlocks: AI-generated daily gesture ideas, weekly date ideas, gift suggestions and the “Ask Amari” assistant; live location sharing and partner distance; unlimited saved memories (the free tier includes 30); unlimited countdowns (the free tier includes 10); and every quiz pack (the free tier includes the Starters, Favourites and Relationship packs in full). One Pro subscription covers both partners in a linked couple.

b. Subscription options. Amari Pro is offered on a weekly, monthly and annual basis. The exact price for your region, in your local currency, together with the renewal period and the details of any free trial or introductory offer, is shown on the purchase screen before you confirm, and on the App Store product page. Prices may vary by region and may change; we will tell you before any change affects your subscription.

c. Payment. Payment is charged to your Apple ID account when you confirm the purchase.

d. Automatic renewal. Your subscription renews automatically for the same period, at the then-current price, unless you cancel it at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period.

e. Managing and cancelling. You can manage or cancel your subscription at any time in the Settings app on your device, under your name → Subscriptions. Cancelling stops future renewals; you keep Pro access until the end of the period you have already paid for. Deleting the app does not cancel a subscription.

f. Free trials. If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription, where applicable.

g. Refunds. Purchases are processed by Apple, and refunds are handled by Apple under the Apple Media Services Terms and Conditions. We cannot issue refunds directly. This does not affect statutory rights you may have under consumer law where you live.

h. Restoring a purchase. Use More → Restore purchase to restore an active subscription on a new device.

i. Changes to Pro. We may add, change or remove Pro features. If we materially reduce what your subscription provides, we will tell you in the App before the change takes effect, so that you can cancel before your next renewal.

6. AI features

a. Third-party AI. Amari’s suggestion features are powered by Claude, an AI model provided by Anthropic, PBC. When you use an AI feature, the relevant context for your request — which may include names, love languages, favourites, dislikes, allergies, relationship dates, your general location, what you typed, and any image you attach — is sent to Anthropic to generate a response. Amari asks for your permission before the first such use, and AI features do not run unless you enable them.

b. No training on your data. We do not use your content to train any AI model, and we do not permit our providers to do so. See section 5 of the Privacy Policy.

c. AI can be wrong. AI generates text by prediction, not knowledge. Output may be inaccurate, outdated, inappropriate or simply poor advice. You are responsible for reviewing any suggestion and exercising your own judgement before acting on it.

d. Fair use. AI features are subject to per-day and per-month usage limits, which exist to keep the service sustainable and to prevent abuse. If you reach a limit, AI features pause until it resets; the rest of the App keeps working.

e. What not to send. Do not submit another person’s private messages, or any government identifier, payment card, financial record or medical record, to the AI assistant.

7. No professional advice

a. Amari is for personal, informational and entertainment use. It is not a medical device or a health service, and we are not a licensed therapist, counsellor, physician or other professional. Nothing in the App is medical, psychological, legal or financial advice, and nothing in it creates a professional relationship between you and us.

b. No guarantees. We make no promise about the state, improvement or longevity of your relationship. Relationship outcomes are yours.

c. If you are in danger. Amari cannot help in a crisis and must not be used as one. If you or someone else is in immediate danger, at risk of harm, or experiencing abuse, contact your local emergency number or a qualified professional or support service in your area.

8. Safety, allergies and assumption of risk

You may record allergies, dietary restrictions or physical limitations so that suggestions can take them into account. We cannot guarantee that AI-generated suggestions — restaurants, recipes, gifts, activities — will correctly avoid every allergen or risk. You are solely responsible for independently verifying the safety, ingredients and suitability of any food, venue, gift or activity before you or your partner acts on a suggestion. To the extent permitted by law, we disclaim liability for allergic reactions, injury or damage arising from reliance on a suggestion.

9. Acceptable use

You agree not to:

  • Use Amari to stalk, monitor covertly, harass, threaten, coerce, intimidate or abuse any person, including your partner.
  • Enter information about another person without their knowledge and agreement, or link with a person who has not agreed to it.
  • Post or share content that is unlawful, hateful, harassing, sexually exploitative, or that depicts a minor inappropriately. We have zero tolerance for abusive or objectionable content and for abusive users.
  • Impersonate another person or misrepresent your identity.
  • Attempt to bypass usage limits, entitlement checks or payment, or gain unauthorised access to any account, system or data.
  • Reverse engineer, decompile or attempt to extract the source code or prompts underlying the Services, except where that restriction is prohibited by law.
  • Use automated means to access the Services, or use them for any unlawful purpose.

Reporting. If your partner or any other user behaves abusively in Amari, you can unlink immediately (More → Leave & start over) and report it to amariaiapp@gmail.com. We review reports and may warn, suspend or permanently terminate an account, and remove content, where we find a breach of these Terms. We aim to act on reports of abusive content within 24 hours.

10. Your content

a. You own it. You keep all rights in the information, text and images you put into Amari.

b. Limited licence to operate the app. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display and process your content solely to the extent necessary to operate the Services for you and your linked partner — for example, to sync it between your devices, to back it up, and to send the relevant context to our AI provider when you use an AI feature.

c. Nothing more. This licence does not permit us to sell your content, publish it, use it for advertising, or use it to train any AI model. The licence ends when you delete the content or your account, except for copies your partner holds and for backup copies, which are purged as described in the Privacy Policy.

11. Our intellectual property

The Services, including the software, design, interface, text, prompts, quiz content and branding, are owned by us or our licensors and are protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Amari on Apple-branded devices you own or control, as permitted by the App Store Terms of Service and these Terms. All rights not expressly granted are reserved.

12. Privacy

Our Privacy Policy explains what we collect, how we use it, who we share it with, and your rights. It forms part of these Terms.

13. Termination and account deletion

a. By you. You can delete your account and its data at any time in the App (More → Delete account). Deletion is permanent. Deleting your account does not cancel an active subscription — cancel that in your Apple ID subscription settings.

b. By us. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we reasonably believe it is necessary to protect other users or the Services. Where it is reasonable to do so, we will give you notice and an opportunity to respond.

c. Survival. Sections 8, 10(c), 11, 14, 15, 16, 17 and 19 survive termination.

14. Disclaimer of warranties

Australian consumers. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

15. Limitation of liability

Where the Australian Consumer Law applies and permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to resupplying the services or paying the cost of having them resupplied.

16. Indemnification

To the extent permitted by law, you agree to indemnify us against claims, liabilities, damages, losses and reasonable legal fees arising out of (a) your misuse of the Services, (b) your breach of these Terms, or (c) your entry of another person’s personal information into Amari without their agreement.

This applies only to the extent the claim is caused by your own act or omission, and does not apply to the extent it is caused or contributed to by our own breach, negligence or wrongful act. It does not apply at all to ordinary, permitted use of the Services.

17. Terms that apply because Amari is distributed through the App Store

The following apply to your use of Amari obtained through the Apple App Store:

a. This agreement is between you and us only, not with Apple Inc. (“Apple”). Apple is not responsible for Amari or its content.

b. The licence granted in section 11 is a non-transferable licence to use Amari on an Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Amari may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

c. Apple has no obligation to furnish any maintenance or support services for Amari.

d. If Amari fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Amari, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.

e. We, not Apple, are responsible for addressing any claim by you or a third party relating to Amari or your possession and use of it, including product liability claims, any claim that Amari fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation, including in connection with Amari’s use of the HealthKit and HomeKit frameworks if applicable.

f. If a third party claims that Amari or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.

g. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable third-party terms when using Amari.

h. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

i. Any question, complaint or claim relating to Amari should be directed to us at amariaiapp@gmail.com, and we will respond by email. If you need a postal address in order to serve a formal legal notice, request it at that address and we will provide one.

18. Changes to these Terms and the Services

We may update these Terms. The current version is always published at amariapp.com/terms and linked in the App under More → Terms of Use. If we make a material change, we will notify you in the App before it takes effect and update the “Last updated” date. If you do not agree to a change, stop using the Services and, if you have a subscription, cancel it before your next renewal. We may also modify, suspend or discontinue features, with notice in the App where a change is material.

19. Governing law and disputes

a. Governing law. These Terms are governed by the laws of New South Wales, Australia. If you are a consumer resident elsewhere, and the law of your place of residence gives you the protection of mandatory local consumer rules, this choice of law does not deprive you of those protections.

b. Informal resolution first. Before starting any formal proceeding, please email amariaiapp@gmail.com and give us 30 days to try to resolve the matter. Most problems can be sorted out this way.

c. Forum. If we cannot resolve a dispute informally, it will be heard by the courts of New South Wales, Australia, and you and we submit to their non-exclusive jurisdiction. “Non-exclusive” means you are also free to bring proceedings in the courts of the place where you live, where the law gives you that right.

20. General

a. Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Services.

b. Severability. If any provision is held unenforceable, the rest remains in effect.

c. No waiver. Our failure to enforce a provision is not a waiver of it.

d. Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets, on notice to you in the App.
